Background:Time Certain Hearing, September 11, 2012, 7:30PM   Board President Deacon will announce the opening of the public hearing on the proposed adoption of Resolution 2012/2013-14 to increase school facility fees.   Board President Deacon will ask for public comment, and close the public hearing.   Education Code Sections 17621 and 17622 and Government Code Section 66001 require school districts to prepare developer fee justification study prior to adopting and/or increasing school statutory school fees (developer fees). The State Allocation Board adjusts the maximum rate that can be levied every two years. This is based on inflation as listed by the state wide index for Class B construction.   Currently, the fee authorized under Education Code Section 17620 may not exceed $3.20 per square foot for residential construction and $0.51 per square foot for commercial/industrial construction. The districts increased their developer fees to the rate shown on the attachment on September 14, 2010.   The district collects school fees on a fifty/fifty basis for elementary and secondary, and collects the fees for our feeder districts. For example, a building permit issued for a 2,000 square foot building in the Cold Spring district would pay Cold Spring 1,000 square foot at their rate, and would pay our district 1,000 square feet at our rate.   Staff has advertised the notice of a potential fee increase twice in a newspaper of general circulation pursuant to Government Code Section 6062A. A copy of the fee has been available for public inspection since August 31, 2012. The effective date of the fee increase will be November 10, 2012.
