Background:

The building authority for the Santa Barbara Unified School District is the Division of the State Architect (DSA).  They review and approve (approval stamp on construction documents is the building permit) projects for school districts in the State of California.  Under Government Code Section 53094, the District is authorized to render the local city or county zoning ordinance inapplicable to such projects.  Without this type of resolution, the district may be required to obtain duplicate approvals from both DSA and the City of Santa Barbara (which will have conflicting requirements).

On April 4, 2017 the Board adopted Resolution 2016/2017-34, exempting the District from local zoning ordinances for future capital projects.  The projects at Las Flores for a building replacement and at Parma for a building replacement were unknown at the time and not included in this resolution and require the exemption for the above reason.

These resolutions implements the Board’s authority under this provision of law and exempts the specified projects in the City of Santa Barbara from the local zoning ordnance.  The resolution requires a two-thirds majority of the Board for approval and adoption.
